Justin Ko successfully makes a half-time submission during a domestic assault by beating trial
Justin Ko represented a defendant who was charged with assault by beating and criminal damage against his former partner at Bromley Magistrates’ Court. Justin was instructed and assisted by Paul Egunjobi of Powell Spencer & Partners Solicitors.
The Prosecution relied on the evidence of four police officers who claimed to have witnessed the defendant assaulting the complainant at her home address. Through careful cross-examination, all four officers conceded that they had not, in fact, seen any assault take place, but had merely heard a loud argument coming from within the property, which gave rise to concern.
The Court accepted Justin’s submissions that there was no evidence of any assault occurring within the property and dismissed the charge at half-time.
The Defendant was convicted of criminal damage following trial, on the basis of recklessness.
