Justin Ko successfully persuaded the Court to make a finding of exceptional hardship
Justin Ko successfully persuaded the Court to make a finding of exceptional hardship in respect of a client who had accumulated 12 penalty points on his driving license and was therefore liable for disqualification under the totting-up provisions at Lavender Hill Magistrates’ Court.
Justin argued that a six-month driving ban would have a serious impact on the Defendant’s employer and his family, particularly his elderly mother, who suffered from serious long-term health issues. Despite the Defendant being heavily cross-examined by Prosecution Counsel – unusual in cases of this nature – the Court accepted Justin’s submissions and found exceptional hardship. The disqualification was therefore not imposed.
