NOTABLE CASES
R v Saif Usman (Aylesbury Crown Court) – Affray and Offensive Weapon
Instructed on a Crown court trial for a defendant charged with one count of affray and two counts of possession of an offensive weapon. Upon instructions from the defendant I successfully negotiated with the prosecutor to accept a plea to the affray and have the possession of offensive weapon lie on file. The defendant was sentenced on the day, the crown had placed the offending in category A2, which had a starting point of 1 year’s custody and category range of 26 weeks’-1 year 6 months’ custody. I successfully mitigated on behalf of the defendant securing a non-custodial order of 18-months community order.
R v Leon Pennell (Bromley Magistrates Court) – Offences Against a Person, S. 20
Secured an acquittal in a S.20 trial. After thorough cross-examination of the complainant, I was able to draw out inconsistencies and unreliability in the identification evidence of the defendant. Following acquittal, I successfully opposed an application for a restraining order.
R v David Solomons (Willesden Magistrates Court) – Stalking and Criminal Damage
Secured an acquittal on both counts. I successfully cross-examined the prosecution witnesses on their accounts being unreliable and flawed. The bench returned not guilty verdicts as there was insufficient evidence for the charges to be made out.
R v Zahjah Blair (Croydon Magistrates Court) – Assault of Constable
Defendant was charged with assaulting a PC with a broomstick. Secured an acquittal after successful cross examination of the prosecution witnesses, highlighting the defendants’ actions were accidental and not reckless.
R v Kingston Bennett (Highbury Corner Youth Court) – ABH and Affray
Instructed to represent a youth defendant in a multi-handed trial. The defendant was charged on indictment with two counts of ABH and Affray. I successfully made representations to the crown prosecutor that the case should be reviewed considering there is no admissible identification evidence against the defendant. The crown offered no evidence in respect of all charges on the day of trial.
R v Craine Croxson (Northampton Crown Court) – Attempted Grievous Bodily Harm with Intent, S.18
Instructed to represent the defendant charged on indictment with two charges of attempted S.18 with intent, possession of an offensive weapon and affray. The allegation concerned two alleged assaults on two complainants on two different days with the use of a weapon, namely a dumbbell. I made representations to the crown prosecutor at the PTPH to accept a plea to a lesser offence of two charges of ABH and an Affray, which was accepted. The defendant was sentenced to a suspended sentence following successful mitigation.
R v Abdelkader Ait Ali (Central Criminal Court) – Multi-Count PWITS Class A and B
Instructed to represent a defendant of good character charged with supplying class A and B drugs. The crown placed the offending in significant role and category 3. This had a starting point of 4 years 6 months custody and a custody range of 3 years 6 months-7 years custody. Following successful mitigation about the defendants’ personal circumstances and his prospect of rehabilitation outside of custody, I persuaded the judge to suspend the custodial sentence.
R v Christopher Bolokor (Isleworth Crown Court) – Criminal Damage and Breach of Suspended Sentence
Instructed to represent a defendant who had pleaded guilty to criminal damage and was consequently in breach of suspended sentence for the offence of being concerned in the supply of Class A drugs. The defendant received a suspended sentence for the criminal damage. The suspended sentence was not activated following successful submissions that the activation of the suspended sentence would be unjust in all the circumstances.
R v Michelle Borovschi (Wood Green Crown Court) – Dangerous Driving and Breach of Conditional Discharge
Instructed to represent the defendant for a sentence who was facing multiple charges on three different case files (dangerous driving, possession of class B, theft form a shop and racially aggravated harassment). The defendant was in breach of a conditional discharge and already had 36 points on her driving licence. Following successful mitigation, the defendant received no separate penalty for the conditional discharge, a driving disqualification and a suspended sentence.
R v Connor Pavoux (Maidstone Crown Court) - Dangerous driving and Driving Whilst Disqualified
Following a guilty plea entered in the Magistrates Court the case was committed to the Crown Court. I was Instructed to represent the defendant for sentence. Following successful mitigation that despite previous convictions of similar offences there was still a realistic prospect of rehabilitation, I persuaded the Judge to suspend the custodial sentence.
R v Kairat Abdurazuloz (Norwich Crown Court) – Fraud and False Identify documents
Instructed to represent a defendant (who was an asylum seeker) charged on indictment with possession of identify documents with improper intention and fraud. I was successfully able to make representation to the Crown to accept a plea only to possession of false identity documents with improper intention. Following successful mitigation, the defendant received a suspended sentence.
